Request a DMV Hearing
In cases where there is a breath test or a refusal, you have seven days from the date of your arrest to request a DMV hearing regarding your license suspension. If you do not request a hearing, your suspension will go into effect on the seventh day.

In blood test cases, the DMV can’t take any action to suspend you unless and until they have a blood result over 0.08. Since blood results may not become available for weeks after your arrest, you will not be able to request a hearing until the DMV has notified you of your impending suspension.
